Terms of Use

To use this Site, you need to agree to the following terms of use.

 

1.  Services.  We are a Real Estate brokerage and we help people buy and sell property.   We also provide real estate-related services that include Property Management, MLS listings, Broker Price Opinions (BPO), Foreclosure Auction Calendars, Tenant Credit Reports, Property Data Records and much more. We have flexible pricing that includes flat fee, by the hour consulting, or traditional commission options.  It’s your choice.

 

2. Eligibility.  Visitors to the site can view information, news reports, how-to guides, and summary information about a listing.  To review detailed information about a listing, you need to register and confirm that you are:

-        a bonafide potential buyer or seller of real estate;

-        not in an exclusive brokerage contract with any other party;

-        over the age of majority and capable for forming legally binding contracts.

3.  Authorized Uses When using the Site for information or to conduct a search for services or available properties for sale or rent, you agree that you will act in good faith and that any representations that you make will be accurate. This means that your searches will be limited to properties that you are financially capable of acquiring or leasing. You agree to use this Site solely for your private (non-commercial) use and that we may limit the number of properties displayed at one time.

4.  Prohibited Uses. This Site and related services may not be used by any person or entity for purposes other than those expressly offered, without written permission from BostonRealEstate.com.  You agree that you will not be disruptive in any way and that you will not attempt to contact the seller or lessor of any property except through an appointment arranged by BostonRealEstate.com. You further agree to prohibit the unauthorized use by a third party, including any electronic or printed real estate listing data, or any other content derived from this Site.

5.  Links and Account Information.   Links are provided as an information service only. It is the responsibility of the user to evaluate the content and usefulness of the information obtained from other Sites.  The inclusion of advertisements does not constitute an endorsement by BostonRealEstate.com of such Sites or the content, products, advertising or other materials presented on such Sites, but are for User's convenience. Users access them at their own risk.

 

6. Information Provided by Users. Users are responsible for providing accurate, timely and complete information to us. We act as a passive conduit. If your information violates any law or causes any harm, you are responsible for the consequences. Your information becomes the property of BostonRealEstate.com and will be used in accordance with our Privacy Policy.

 

8.  Billing and Payment Policy. Users will pay fees according to the prices set forth on the BostonRealEstate.com web site.  We will charge your credit card or invoice you monthly.  We strive to ensure the security of all credit cards and other personal information; we expressly disclaim any liability for any damage that may result should any such information be released to any third parties.   

 

9.  Indemnification. By agreeing to the terms of this Agreement, you agree to indemnify, defend and hold harmless BostonRealEstate.com, its directors, officers, employees, principals, agents, licensors, attorneys, independent contractors, providers, subsidiaries and affiliates (collectively referred to herein as "BostonRealEstate.com") from and against any and all claim, loss, expense or demand of liability, including attorneys' fees and costs incurred by BostonRealEstate.com and Affiliates in connection with any claim arising from your actions.

 

10.  Modification of the Terms of this Agreement. BostonRealEstate.com reserves the right to make changes to this Agreement from time to time. BostonRealEstate.com shall provide notice to you of any substantive and/or material changes to this Agreement or any policies posted on the Site.

 

11. Term & Termination. This Agreement will become effective immediately upon any use by you of the Site. Either party may terminate this Agreement by providing the other with written or email notice of such termination. No reimbursements for any fees charged shall be issued where reason for termination is due to the violation of these terms.   

BostonRealEstate.com reserves the right to terminate your privileges to use this Site at any time and at its sole discretion for any reason or no reason at all.  In the event of termination, the following sections shall survive: Term of Agreement; Intellectual Property Rights, Disclaimer; Indemnification; Dispute Resolution.

 

12. Intellectual Property Rights. The whole Site is owned by BostonRealEstate.com or is used with permission of the rightful owner.  Any use the Site other than as permitted herein, is expressly prohibited without the prior written permission of BostonRealEstate.com and/or the relevant right holder. 13.  Notice of Trademark Rights. The service marks, trademarks, logo and domain are owned by BostonRealEstate.com. Any other trademarks, service marks, logos and/or trade names appearing on the Site are the property of their respective owners. Users may not copy or use any of these marks, logos or trade names without the prior written permission of the owner except as expressly allowed by these Terms of Use.

 

14.  Modifications to the Site. BostonRealEstate.com reserves the right in its sole discretion to review, improve, modify or discontinue, temporarily or permanently, the Site or any content or information on the Site with or without notice to user.

 

15.  Privacy. BostonRealEstate.com's Privacy Statement located on its Site, as it may be modified from time to time shall govern any disclosure or use of your personal information. By using this Site, you confirm that you understand and agree to those terms.

 

16.  Password and Used Id.  You are responsible for maintaining the confidentiality of any password, user id selected when you register or provided by BostonRealEstate.com. You are fully responsible for all activities that occur under your user name or password or account. You agree to immediately notify BostonRealEstate.com of any unauthorized use of a user id or password or any other breach of security.

 

17.   Agency:  You and BostonRealEstate.com are not in an agency relationship when you use the site for informational purposes or purchase services not related to buying and selling real estate.  You will enter into an agency relationship with BostonRealEstate.com when you ask an agent to show you property available for sale or lease, or you request assistance in arranging a real estate transaction.  A BostonRealEstate.com agent will disclose to you the nature and extent of the duties and obligations of an agency relationship no later than the time of your first personal meeting to discuss a specific piece of property.  

 

19.  Disclaimer of Warranties.  BostonRealEstate.com does not control quality of information provided by third parties.  USER EXPRESSLY AGREES THAT THE USE OF THE SITE IS AT USER'S SOLE RISK.

20. Dispute Resolution. In the event of a dispute, we agree to use friendly mediation to resolve it.  If mediation is not successful, we agree that the dispute shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association, conducted in the Boston area and under the laws of the Commonwealth of Massachusetts without regard to its conflict of laws provisions.
